WILL AND TESTAMENT IN INDONESIA; GENERAL UNDERSTANDING

will and testament in IndonesiaAn Indonesian will or testament is a legitimate written statement made by an Indonesian citizen or an Indonesian residence that made the last will or testament, which specify what shall happen to his or her property or personal belongings when the will or the testament maker (a testator) has pass away.  Generally, the Indonesian will or testament is made unilaterally, created on the testator own desire and under the testator free willingness and full awareness. Because of the unilateral nature, an Indonesian will or testament can always be withdrawn by the testator.

 

 

Under Indonesian law, there are numerous things such as rights and obligations, property distribution, or etc that may be enlisted by the testator into his or her will or testament,  however, the Indonesian law defines that any statement listed on the will or testament must not contradict with the law and regulations in effect in Indonesia. will_testamnet

 

INDONESIAN WILL AND TESTAMENT TERMS & CONDITIONS

  1. REGARDING THE TESTATOR

The following obvious qualifications must be met by a testator, Prior incorporating an Indonesian will or testament:

1.      The prospective testator must able to think clearly and rationally;

2.      The prospective testator is completely aware of all the aims and objectives on the Indonesian will and testament made;

3.      The prospective testator is aged 18 years old or an adult.

 

  1. REGARDING THE CONTENTS OF THE WILL OR TESTAMENT

1.      An Indonesian will and testament must be made in clear language, easy to understand and does not contradicts with the Indonesian law and regulations in effect or violate any obscenity;

2.      An Indonesian will and testament must be made in accordance with the reality facts, the truth and should not contain any falsity, deceit or so.

3.      An Indonesian will and testament must be made within the free will of the testator.

 

The above mentioned terms and conditions is a general restrictions and requirements regarding an Indonesian will or testament. Under Indonesian inheritance law, there are numerous prevention and prohibition in regards to incorporating an Indonesian will or testament, particularly in regards with the “LP” (Legitimate Portie) or the proportional parts for the heirs. A suitable Indonesian will or testament should not reduce the proportional parts for the legitimate heirs.
